Waiver
RELEASE AND WAIVER - THIS ENTRY CONTAINS A LIMITATION ON YOUR LEGAL RIGHTS - PLEASE READ!
I wish to enter and participate in one of the "Oil Creek 100 Trail Runs" events. I agree with the rules, conditions and regulations of these events and will comply with them. I am aware that races of these distances are extremely difficult and hazardous for even well conditioned athletes under the most favorable conditions. I am aware that during a pandemic (for example, Coronavirus / COVID-19) I may be required to put on a mask when around others, to enter an aid station or the finish line area, or to provide proof I have had a vaccine to participate. I further agree to abide by the Center for Disease Control’s (CDC) recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other communicable diseases, and I attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html. I am physically fit and sufficiently trained to participate in this endurance event and assume all risks of such participation. The races cover difficult and hazardous terrain. I have been warned that I should not participate in these events unless: a) I am in excellent physical condition; b) I have previously covered endurance distances on foot during a race or training run; and c) I have recently had a complete examination, preferably including a stress electrocardiogram. d) I may be required to provide proof of a pandemic-related vaccine.
I have also been advised that I may be exposed to physical injury and the risk of death from a number of factors, including but not limited to mud and water on steep trails, rocks and roots, near-vertical drops along some sections of single-track trail, lightning, wild animal encounter / attack, 1860’s oil relics such as steel rods and pipes, and hazards associated with running along or across roadways, bike paths, one lane bridges, and railroad tracks at day or night. I accept responsibility for the condition and adequacy of my gear including reflective safety clothing and personal lighting during periods of darkness. I understand and agree that situations may arise during the race, which may be beyond the control of the race officials or organizers, and I must continually run so as to neither endanger myself, nor others. These factors also include, among other things, the fact that I may become injured or incapacitated in a location where it is difficult or impossible for the event’s management to get required medical aid to me in time to avoid physical injury or even death. Knowing these facts, I nevertheless in consideration of your accepting this entry, hereby for myself, my heirs, executors and administrators, waive, release and discharge race organizers, PA Department of Conservation and Natural Resources (DCNR), Oil Creek State Park, City of Titusville, Titusville Area School District, Oil Creek & Titusville Railroad, Drake Well Museum, Pennsylvania Historical and Museum Commission, Road Runners Club of America (RRCA), Friends of Oil Creek State Park, any official sponsor entity, and the officers, directors, shareholders and/or members, agents and employees of each, all medical and other personnel assisting with the races, volunteers or any other persons connected with these race events, their representatives, successors and assigns, from any and all rights, claims or liability for damage for any and all injuries to me or my property, or damage caused by me or by anyone else (including Acts of God), arising out of or in connection with my participation in this event. I further agree that I will defend, indemnify and hold harmless the “Oil Creek 100 Trail Runs” or any official sponsors, and the directors, officers, elected officials, members and agents of each, against all claims, demands, and causes of action, including court costs and attorneys’ fees directly or indirectly arising from any action or other proceeding brought by or prosecuted for my benefit contrary to this agreement. This release extends to all claims of every kind and nature whatsoever, whether known or unknown. I grant my irrevocable permission to the Oil Creek 100 Trail Runs, and its authorized agents, to use my name and any photographs, videos, motion pictures, recordings, or any other record of my participation in this event. Race management reserves the right to refuse any entry.
